      <![CDATA[<p><img src="http://www.readwriteweb.com/images/scrabulous-logo.jpg">As of today, Scrabulous, the wildly popular Facebook Scrabble game, is no more. If you try to login to the app now you'll get the message "Scrabulous is disabled for U.S. and Canadian users until further notice." You have the option of entering your email address to receive further information about developments in the matter. While Scrabulous fans are certainly angered over the app's shutdown, the unanswered question still looms: did Hasbro have to do this?</p>]]>
      <![CDATA[<h2>The Troubled History of Scrabulous</h2>

<p>Last week, Hasbro filed suit against Rajat and Jayant Agarwall, the brothers who created the app two years ago. The game, as you may know, doesn't just take inspiration from Scrabble, but rips it off entirely and transports it to the web...triple word scores and all.</p>

<p>On the one hand, the brothers should be congratulated for having the foresight to see how popular an online version of this game could be - it quickly rose to become one of the all-time favorite games on Facebook's social network with over 500,000 daily users. On the other, you have to wonder what other result the Agarwall brothers could have hoped for at this point. </p>

<p>Although <a href="http://www.readwriteweb.com/archives/hasbro_goes_after_scrabulous_bogglific.php">Hasbro sent a takedown notice back in January</a> to Rajat and Jayant Agarwall, they later tried to come to an agreement with the brothers over the rights to the game. In fact, Electronic Arts, RealNetworks, Mattel, and Hasbro - the four U.S. companies that each have some of the rights of Scrabble - came together to offer the brothers a large sum of money which would have allowed them to keep a version of the game up and running. </p>

<p>According to <a href="http://www.nytimes.com/2008/03/02/business/02game.html?_r=2&amp;oref=slogin&amp;oref=slogin">this New York Times article</a>, Jayant Agarwalla said that he and his brother did not create Scrabulous to make money - they just wanted to play Scrabble on their computers. So why didn't they accept the big check then? The brothers decided to turn down the check, rumored to be around the $10 million mark; apparently, they were holding out for more money. How much more? A multiple of several times $10 million by some accounts. Even though the game, by all fair estimates, was <a href="http://www.alleyinsider.com/2008/3/the_scrabulous_snag__money">probably only worth around $3-6 million</a>, the brothers felt they deserved more. </p>



<h2>Was This A Big Mistake?</h2>

<p>While some are calling the Scrabulous shutdown a great blunder on Hasbro's part, we wonder what other solutions could the company have taken to protect their brand? Or is it time for companies to give up trying to protect their brand altogether and just learn how to better compete with those that counterfeit their copyright? This question is truly the basis for all the arguments surrounding the piracy issue - that is, whether it's worthwhile to go after pirates, thieves, and copyright-infringers, or whether it's better to simply let them be and consider it free advertising. </p>

        <![CDATA[<p>Wow, and you wonder why the US has laws like the DMCA. Reading people's posts on this topic is downright disappointing. The number of people who "side with Hasbro" is a sad testament to the state of copyright in the US, but at least it means that the government, in passing things like the DMCA, and repeatedly extending the terms of copyright, is actually reflecting the will of the people. </p>

<p>they made a game that has an uncanny similarity to the game Scrabble (which by the way, was invented more than 60 years ago), and they gave it a name that people would definitely associate with Scrabble, so that people would recognize that it is a Scrabble-like game. They used the same board layout, and the same scoring mechanism. And you know what, they are acting completely within the copyright laws in doing so. They do not claim that their game is the official Scrabble, and they do nothing to misrepresent what their game is, a Scrabble-like game that can be played online.</p>

<p>The number of people who are siding with the big bad company who just launched their own game, and is using their expensive lawyers to get rid of any competition, is really disturbing. I guess big business really has won.</p>]]>

<p>  Ask yourself this:  Why did those two weasels name the online game "Scrabulous"?</p>

<p>  Since critical thinking apparently isn't your strong suit, here's the answer:  They wanted to freeride on the Scrabble trademark.</p>

<p>Also, good job quoting something that wasn't even in the link you offered.  Before mentioning you read the rumor in SA (unverified and anonymous), everyone that clicked over to the NYT story would've found nothing about any buyout offer...appearing as if you made it up out of thin air.</p>

        <![CDATA[<p>Hasbro has a trademark right in the Scrabble name, in addition to copyright on the layout of the board, etc.</p>

<p>  The brothers were foolishly wrong to name the online game "scrabulous".  When they did that, they guaranteed that Hasbro would have to sue them because trademark rights can be lost if they're not defended by the mark holder.</p>

<p>So Hasbro had to stop Scrabulous or risk losing its trademark in Scrabble.  Hasbro did the right thing.  The brothers didn't.  They're just common thieves.</p>]]>

        <![CDATA[<p>No, the worst part is having used a blank to build DREAMS for only 18 points, then JAM for only 16 points (hopefully not MEW for only 14 points, which would be kinda pathetic).</p>

<p>It is a crime against humanity to use a blank to play anything less than a bingo, for anything less than 56 points (except in certain cases, depending on the context).</p>]]>

        <![CDATA[<p>No matter who is right or wrong (only the outcome of this lawsuit will tell, despite the many pronouncements of weekend lawyers on various boards), in the end, the customers were treated poorly. No warning, nothing. Have ongoing games... too bad! Have people you played with you want to keep in touch with, but did not befriend yet... too bad! Wanted to keep your list of stats and bingos for reference... too bad! Thank God for free proxy servers, but the average Joe is basically fucked. Moreover, the ability to play with ANYONE you want around the world has been seriously compromised for the future, unless Hasbro and Mattel enter some kind of agreement.</p>

<p>On a different note, I can't believe that the brothers refused $10M. I would have taken the money immediately and used it to build something innovative, maybe stayed as a highly paid consultant for EA to help them better understand what they went through, what they learned from their 500,000+ customers, etc. It was clear that things would get ugly at some point. But, of course, only the brothers really know why they did not take the money, if money was indeed put on the table.</p>

        <![CDATA[<p>I do wonder about the offer to the brother's though - they say they don't want to make money, but they are holding out for more? </p>

<p>If Hasbro did all they could to join forces with the brothers, then I agree this was the right move. However, if not (which just seems to resonate more with the situation) then maybe they should try again.</p>

        <![CDATA[<p>I'll admit to knowing nothing about copyright law but I find it hard to believe that arranging letters on a board of a certain size to spell words, even with the configuration of bonus squares, should be indefinitely protected. Is it so dissimilar from chess? I realize the futility of arguing against something which, by letter of the law, has reason for being that is complex and has evolved within the framework of our legal system, but it is annoying because I liked playing the ONLINE version dammit. It was 99% of the reason I went to facebook every day. Guess I don't really blame one side or the other here... I would have preferred hasbro et al to make a competitive version first then act.</p>]]>

        <![CDATA[<p>ReadWriteWeb once again demonstrates what a great site they are by publishing another balanced, well-reasoned article on a current issue.</p>

<p>Even though I was a huge Scrabulous fan and it was the only Facebook game I played regularly, it was a clear violation of intellectual property laws.  And I'm a bit surprised how some people are saying Hasbro et al. were stupid for not just buying up Scrabulous - as much as I liked Scrabulous, this kind of piracy ought not be encouraged or rewarded.  The companies were quite generous in offering a deal to the Scrabulous developers at all.</p>

<p>You raised some good questions as well... I do think the biggest lesson is learning to defend a brand via competition.  If the makers of Scrabble had built a quality application to begin with, Scrabulous would probably have never taken off.  And while some "piracy" can be seen as helpful advertising (e.g. a fan site that uses copyrighted images), there are cases where I think a company is right to take action - and this is one such case.</p>

<p>I'd also add that even in the helpful cases, a company has to be very careful.  As much as us techies rightly talk about problems with copyright/patent/trademark systems, they remain very important systems that ultimately do benefit consumers.</p>]]>

        <![CDATA[<p>Ontario - well, that is one of your choices as a copyright holder, but generally speaking most copyright holders DO want to make money. Of course, Hasbro's version may not be as good as Scrabulous (the official iPhone Scrabble app suggests this is possible) or as innovative on the social side. And that is another matter.</p>

<p>What we really need - and has been proposed - is a 'use it or lose it' clause to copyright ownership, with rights reverting first to the creator, then the public domain. Some contracts already have this in, but it seems a good principle to widely establish.</p>]]>

        <![CDATA[<p>I actually side with Hasbro.  All things considering, they handled this fairly.  Scrabulous went up - and they were perturbed that their Intellectual Property was being used.  They could have shut it down immediately.  They worked with the Scrabulous guys and, according to this, attempted to settle with them.  The Scrabulous guys were in the wrong and really had no leg to stand on.  The fact that they were offered anything - especially that much money - they should have been relieved.  Instead, Hasbro called their bluff and shut them down (somewhat - you can now go to their site to play).  If I was Hasbro or anyone else that owns the IP of Scrabble, I'd send the attack dogs.  No need to play nice anymore.  </p>]]>

        <![CDATA[<p>Having worked for several software companies, I tend to side with copyright holder, but there's one thing that disturbs me. A copyright holder has the right to release a work, but also has the right NOT to release a work. So Hasbro could choose to never release Scrabble online, Disney could choose to pull their movies off the market and only sell them at selected times, Warner Brothers could choose not to do business with last.fm, etc. While these companies are legally in the right, it still bugs me that I may have to resort to illegal means to obtain a work, should the copyright holder choose not to release it.</p>]]>
