Instead of promoting "hope," these posters feature U.S. President Barack Obama wearing the Joker's clown makeup from the Batman movie "The Dark Knight." Even those outside of L.A. have likely seen this image somewhere as it soon took on a viral nature, appearing both online and in other cities across the country. The politically charged (and rather disturbing) photo serves as a counterpoint to the prolific and iconic "hope" posters that became popular during Obama's campaign. Regardless of which side you favor, one thing can be said about this photo: it definitely grabs your attention. </p>]]>
      <![CDATA[<p>But now, according to the photo's creator, Firas Alkhateeb, a 20-year-old college student from Chicago, the image has been removed from photo-sharing website <a href="http://flickr.com">Flickr</a> due to "copyright infringement concerns." Really? Is that why? Or is Flickr engaging in political censorship? </p>

<h2>About the Photo</h2>

<p>The posters that popped up across the country were based on Alkhateeb's photo, but had the TIME magazine logo and branding removed and had added the word "socialism" at the bottom. Alkhateeb wasn't responsible for these changes - a yet-to-be-identified person is behind the posters' creation. </p>

<p>In fact, you may be surprised to hear that the Obama/Joker image wasn't even meant to be political commentary, according to Alkhateeb. That's quite ironic given that it has now embroiled him in this intense political debate. Instead, says the college student, he was just messing around after discovering an online tutorial that explained how to "Jokerize" photographs using Adobe Photoshop. It seems that Alkhateeb doesn't particularly care about politics himself, having chosen to abstain from voting in November since he felt his state (Illinois) was already sewn up and decided before the polls opened. His views on Obama aren't particularly one-sided either. Alkhateeb favors the democratic viewpoint on foreign relations but tends to side with Republicans on domestic issues.</p>

<p>In a recent <a href="http://latimesblogs.latimes.com/washington/2009/08/obama-joker-artist.html">L.A. Times profile</a> on Alkhateeb, it's reported that the photo generated over 20,000 page views during the time it was hosted on the photo-sharing website <a href="http://flickr.com">Flickr.com</a>. However, as of last Friday, Flickr removed the photo from their site. Why? Alkhateeb says he received an email from the company stating it had to be taken down due to <em>"copyright infringement concerns."</em> (Apparently, TIME magazine wasn't too happy seeing their brand associated with this sort of political commentary.)</p>

<h2>What About Free Speech?</h2>

<p>But isn't this sort of political commentary, political <em>parody</em> in fact, protected as a form of free speech? Noted photographer and blogger <a href="http://thomashawk.com/2009/08/flickr-censors-political-image-critical-of-president-obama.html">Thomas Hawk</a> thinks it is, citing a precedent for fair use (Folsom v Marsh) which states "if you produce something that is transformative, and not derivative, then it's fair use." Although Hawk isn't a lawyer, he may be right on this one. <a href="http://latimesblogs.latimes.com/washington/2009/08/obama-joker-artist.html">Says Corynne McSherry</a>, a senior staff attorney at the <a href="http://eff.org">Electronic Frontier Foundation</a> (EFF), a nonprofit that defends digital rights, Alkhateeb has a strong fair use defense if he was ever sued. "You really want to think twice about going after a political commenter," she noted. </p>

<p>This wouldn't be the first time Flickr got involved with political censorship. Hawk also blogged about how the site <a href="http://thomashawk.com/2009/06/flickr-user-posts-comments-critical-of-obama-on-the-official-white-house-photostream-and-has-his-comments-along-with-his-entire-flickrstream-deleted-without-warning.html">deleted the account of a user named Shepherd Johnson</a> after he made critical comments about Obama in the Official White House Photostream back in June. </p>

<p>So is this yet another case of Flickr engaging in censorship? Or are they legitimately protecting themselves from these "copyright infringement" claims? (Flickr won't comment on this since a company policy prohibits them from discussing issues surrounding one particular user.)</p>

        <![CDATA[<p>This takes me back about six decades to my childhood. I used to carry a crayon and couldn't resist improving(?) any posters I passed by drawing spectacles, beards and moustaches on the unfortunate subjects. It seemed like good fun at the time and no-one ever particularly cared and I never even received a slap around the head (the usual way instant justice was meted out before disciplining children became criminalised). In my opinion my childish renderings were far better than this example and I still think that spectacles and a moustache would be an improvement and more fun. Unfortunately I don't do it any more because I think at some point I grew up.<br />

        <![CDATA[<p>In practical terms, fair use does not mean what many people think it means. There is the fair use provision as written and there is the fair use provision as it's been  upheld in court. Non-commercial helps, but it doesn't give someone carte blanche. And as for parody, whether you win or lose in court with that defense depends on what your parodizing. Alkhateeb isn't parodizing the Time cover, he parodizing Obama.</p>

<p>That being, there are plenty of publicly available photos of Obama that he could have used as a basis for the image. He chose not to use a public domain image. Instead, he chose to use a copyrighted one. Someone reported it, who knows who, Flickr looked into it, found that it was, indeed, a copyrighted image (and a violation of their terms of use), they took it down. DMCA provision or no, it was well within their rights to take it down.</p>

<p>Free speech grants Alkhateeb the right to create the image (and court any copyright issues). But Flickr and Yahoo are not public services. Like it or not, they are businesses. They are under no obligation to help any of us express our right to free speech.</p>

<p>We might not like how copyright laws are enforced, but we should work to change those laws rather than crying "censorship" just to drive more traffic to a blog post and further feed the partisan divide in the US.</p>]]>

<p>The Digital Millenium Copyright Act (DMCA) provides a safe harbor for web sites, like Flickr, that have user generated content. To fall within the safe harbor, Yahoo! (Flickr) must comply with certain requirements. It sounds like the company's actions are intended so it may continue to fall within the safe harbor provision. In other words, copyright disputes are often a case of he said, she said. The law provides companies a very convenient way to decide -- follow the rules/process provided in the safe harbor. </p>

<p>Moreover, those DMCA safe harbor provisions provide a very clear process to follow. Whoever filed the claim against the photo declared under penalty of perjury that they are the copyright owner. Yahoo has little choice once a complaint is filed that meets the DMCA safe harbor provisions, as provided in Yahoo's copyright reporting procedures.  <a href="http://info.yahoo.com/copyright/us/details.html" rel="nofollow">http://info.yahoo.com/copyright/us/details.html</a> </p>

<p>It is now up to Firas Alkhateeb, as the Flickr member, to counter claim or work something out with the alleged copyright owner. As this is parody, transformative of the original work, and apparently for non-commercial purposes he likely has an extremely good case for fair use. I hope a copyright attorney agrees to represent him pro bono in this case. Otherwise, he's not likely to bother filing a counter claim. Hint, hint to copyright lawyers in the crowd. Perhaps Time will then lift its complaint if he agrees to remove its trademarks.  </p>]]>

        <![CDATA[<p>Practically, as I've seen with message board discussion forums and other "free" services, the owners of website determine what is & isn't acceptable and there is little recourse you have except to 1) move your material/comments to a more hospitable environment or 2) start a competing forum/service where you can set the rules!</p>

<p>As far as I know, suits regarding censorship primarily refer to incidents of silencing by or within a public/governmental entity. It seems that, except for in cases of explicit discrimination, private entities can set whatever rules they want.</p>

        <![CDATA[<p>It's still not clear to me how this image got on the cover of Time magazine. What is the sequence of events? Did someone from Time go onto Flickr and take this image to use? Or did someone grab the image from Flickr, create posters, and then Time grabbed the image to report on the phenomenon of the posters? </p>]]>

<p>Registered trademarks have huge value to the owners of the trademarks ... Time's logo is one of the most valuable trademarks in the magazine industry.</p>

<p>Having its trademark used in anyway without its approval is a serious violation of the company's rights ...</p>

<p>The poster does it's job just fine without the Time logo - It's equally as disturbing as the "1984" invoking "hope" posters.</p>]]>

        <![CDATA[<p>Companies must do due diligence to protect even the idea that they are copyrighting something. If they do not, and another case of true copyright violation comes along, the defendant can point to any cases where the copmpany did not at least make an attempt to protect their copyright.</p>

<p>In a case like this, however, simply copy the'M' in TIME and replace the 'T' in TIME with another 'M' and then it'll be parody. Easy fix. MIME would fit nicely.</p>

<p>And I find the image slightly disturbing, too, if only because of that grimace. Nothing to do with politics or where I stand on Obama or anything else. If you don't find a rictus like that disturbing at all, chances are good you are already disturbed.</p>]]>

        <![CDATA[<p>I posted this on FF and will copy it here...I'm trying to find the case I'm referring to but I can't remember its name:</p>

<p>I don't approve any sort of censorship nor do I think Copyright law is perfect but this can easily be a case of Copyright Infringement. Free Speech is weakened when used through symbols and images. The Court divides the actual message from the means of producing it. To permit it, both must be legal (so you may have a perfectly legal message conducted in an illegal way in which the Court will prohibit the conduct). In terms of Copyrights it is Fair Use to use a popular character to criticize said character (or its parent company). There is a case where, if I remember correctly, someone used a popular animated character to portray Uncle Sam in order to carry out a political message. The Court found that he wasn't protected by the Fair Use defense since he wasn't parodying the character but was instead using it to mock, comment or criticize something else. It's very plausible the same thing is happening here. The author is using the traits of a popular character (the Joker) and the template of a Time magazine without criticizing or commenting on either of them.  In the sense that the author is neither commenting on The Joker or Time Magazine he's infringing those copyrights. I don't agree with this, but as far as I remember it's the law today.</p>

<p>Also fair use is a complicated defense which is applied on a case by case basis. There isn't a bright-line rule to apply it. The same can be said of the limits of free speech. if you produce something that is transformative, and not derivative, then it's fair use." is a very simple way to look at the fair use defense since that isn't always the case. In fact I really wish that was the case since most music sampling artists would be doing something legal (the courts finds music sampling illegal, sadly).</p>]]>

        <![CDATA[<p>A parody is only a parody if there's an obvious distinction between the two.  An uninformed viewer must be able to recognize that it is in fact satire.</p>

<p>With the Obama picture, since it has the logo, and the modifications are seemlessly integrated into the picture, it's impossible for the visitor to distinguish what is real and what is parody.</p>

<p>The reason why the Barack Obama picture was brought down and the Bush one wasn't, is because the Bush photograph didn't have anyone's branding on it and it was an original piece of work, commissioned by Vanity Fair.</p>

<p>In the Obama photo, it is a manipulation of the original piece of work to convey a different message. The problem is it's not a parody because of the reasons listed above.</p>

<p>Now, if they were to take off the Time branding and other items, then it might be considered parody. </p>]]>

        <![CDATA[<p>The major problem with "Free Speech" is people who push this ideaology definately do not believe in it unless it affects their free speech.  They are the first to criticize others opinions, and they are against the expression of views that are different from their own. They are even against their own free speech if you just stop and listen to them.  Yes, they have an argument, but it is full of hatred and serves no purpose except to spin their hatred, greed, and selfishness in the name of the Lord.  However, these views are based on narrow perspectives that are dependent on weak minded people who refuse to think for themselves and refuse to question.  Sadly, these people just give their minds over to evil and are told whom to hate, whom to love, and whom to be.I am an advocates of "Free Speech.  However,freedom of speech is nothing without freedom of thought.    </p>]]>

        <![CDATA[<p>Since Flickr is owned by Yahoo, I'd ask how many Yahoo executives contributed to Democrat party and candidates, and how much they contributed?</p>

<p>Surely they are intelligent, but not business-savvy, people.  Surely they know that parody is protected speech.</p>

<p>This may be related to Google posting a Google Map showing the location of Prop 8 supporters.  The only reason Google would do that would be to intimidate their political opponents and facilitate their political supporters to vandalize their property and cause harm to the occupants.</p>]]>
